Therm Products Warranty
HEATER & ELEMENT WARRANTY
Effective April 20, 2010
Therm Products warrants to the Purchaser, that
the heater or element delivered hereunder will be free from defects in material
& workmanship, and will be of the kind and quality described in the
contract, when they leave our factory. If damaged in shipment, a claim should
be filed promptly with the carrier. This warranty is exclusive, and in lieu of
all other warranties, whether written, oral, or implied (including any warranty
of merchantability or fitness of purpose.)
Therm Products warrants only the product as
specified above, since we have no control over the applications of the heaters
or devices in which they are installed.
Limitation of Liability: The Company assumes no
special or consequential liability. Liability on any claim of any kind,
including negligence, shall in no case exceed the price allowable of the heater
or element supplied. It is the customer’s responsibility to determine by tests,
calculations, or other means, the suitability of the heater for the
application.
All Therm Products Heater Elements and Heater
Assemblies are warranted against manufacturing defects, for a minimum period of
12 months from date of manufacture. Dry fire, corrosion due to water chemistry,
physical abuse, and freeze damage are not covered. Any additional element warranty
coverage is noted below.
Standard Elements & Heaters warranted
against manufacturing defects from date of manufacture for 12 months. Dry
fire, physical abuse, and freeze damage are not covered.
Coated Elements & Heaters (“TE”
& “EP”) warranted against manufacturing defects from date of manufacture
for 18 months. Dry fire, physical abuse, and freeze damage are not
covered.
Titanium Elements & Heaters (Titanium
Components Only) warranted against manufacturing defects from date
of manufacture for 24 months with 60 months corrosion protection. Dry
fire, physical abuse, and freeze damage are not covered.
Any Therm Products heater or heating device
claimed to be defective in material and/or workmanship when it leaves our
factory, should be returned to the company with a Returned Goods Authorization
number obtained from Therm Products directly. Freight costs incurred for
product return, will be billed back to the customer if the products are found
to be outside the warranty period, no failure found, or damaged by the
customer.
Product failures occurring outside the United
States, Mexico, and Canada, may require only written
permission to return the product label only, to obtain credit. However, Therm
Products reserves the right to request that units be returned at any time for
evaluation, if the number of returns exceeds 2% of the units shipped. Therm
Products requires that all units be returned for evaluation, corrective action,
before returning to the label only program.
RETURNS:
All products returned for warranty evaluation,
will require an RGA number before shipping. All RGA shipments must be sent
prepaid without exception. Shipments arriving without an RGA, or sent freight
collect, will not be accepted. Any parts shipped to Therm Products and
determined to not be covered under warranty (no fault found, corrosion due to
water chemistry, past warranty date, abused, dry fired, etc,) will be returned
at customers expense, or scrapped with 30 days of notification.
CREDITS:
All credits resulting from the return of
defective materials, or final disposition on non-warranty returned goods, will
be provided within 30 days. At our option, Therm Products agrees to
replace the defective item with a similar part, or issue monetary reimbursement
in the amount paid for the item only. A copy of the credit statement will be
mailed to customers accounting department, unless requested otherwise.
